Indian
garment firm restrained from using Intel’s brand name

The
Delhi high court has granted injunction in favour of computer major
Intel Corporation on the allegation that an Indian readymade garment
manufacturer was using Intels brand name to promote its product.
Justice
H R Malhotra in an ex-parte order restrained the Punjab-based Rajgiri
Knitwears and its agents from using the trade mark Intel
in any form in its business.
Advocate
Manmohan Singh, appearing for the US software and telecommunication
giant, had contended that the Ludhiana based company was using the
impugned trade mark for its T-shirts, kidswear, caps and other garments
illegally to encash upon the reputation of the US multinational.
The counsel alleged that the dishonest intention of Rajgiri Knitwears
was evident from the fact that it was using an identical mark Intel
with dropped E logo on the labels and price tags which
was created by the American company.
Contending
that the use of the impugned mark by the local firm was in violation
of US companys common law rights in the trade mark Intel,
the counsel said the adoption of identical mark by Rajgiri Knitwears
amounted to misrepresentation. Intel Corporation said it has entered
into other revenue producing business and some of its products include
T-shirts, polo-shirts, denim-shirts, etc. Upholding these contentions,
the court restrained the proprietors and agents of the Indian firm
from manufacturing and marketing T-shirts, readymade garments and
any other products bearing the mark Intel or Intel Corporations
dropped E logo or any mark deceptively similar to the
American companys trademark.
